Terms of use

These Terms of Use ("Terms") govern your access to and use of the Canvas and Crew Marketplace, located at brainquestdesigners.wixstudio.com/canvas-crew ("Marketplace"). By claiming, downloading, or using any template from the Marketplace, you agree to be bound by these Terms. If you do not agree, do not use or claim any template.

1. About the Marketplace

Canvas and Crew ("we," "us," or "our") operates a free template marketplace where professionally designed Wix Studio templates are made available to individual users and businesses. All templates listed on the Marketplace are offered at no monetary cost and are transferred to purchasers using the official Wix Site Transfer method.

2. Eligibility

You must have a valid Wix account to receive and use a template. By using the Marketplace, you represent that:

You are at least 18 years of age or have parental/guardian consent.
You have the legal authority to agree to these Terms on behalf of yourself or your organization.
You will use the template only in accordance with these Terms and all applicable laws.

3. Template Acquisition & Transfer

Templates are transferred via the official Wix Site Transfer feature. Once a transfer is initiated, the template will be delivered to the Wix account you provide. We are not responsible for delays caused by Wix platform issues, incorrect account information provided by you, or communication errors outside our control.

4. Prohibited Uses

By accepting a template from our Marketplace, you expressly agree NOT to:

Re-sell, redistribute, or transfer the template (or any derivative of it) to any third party, whether for free or for payment.
Upload the template to any other marketplace, template library, repository, or platform for public or private distribution.
Share your Wix account credentials with others for the purpose of accessing or duplicating a transferred template.
Use the template as the basis for creating a competing template marketplace or product library.
Strip, remove, or obscure any attributions, metadata, or credits embedded within the template.
Use the template in any manner that violates applicable laws or infringes the intellectual property rights of Canvas and Crew or any third party.

5. Modifications

You are permitted to customize and modify a template for your own personal or business website. However, modification does not transfer or expand ownership rights. Modified templates remain subject to all restrictions in these Terms and the Single-Use License Agreement.

6. Intellectual Property

All templates, designs, graphics, layouts, code, and associated content on the Marketplace are the intellectual property of Canvas and Crew or its licensors. Your acceptance of a template grants you a limited, non-exclusive, non-transferable, revocable license as described in Section 3. No ownership rights are transferred to you.

7. Marketplace Availability

We reserve the right to modify, suspend, or discontinue the Marketplace or any template at any time without prior notice. We are not liable to you or any third party for any changes, suspension, or discontinuation of the Marketplace.

8. Disclaimer of Warranties

Templates are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that templates will be error-free, compatible with all Wix plans or apps, or meet your specific requirements. Your use of any template is at your sole risk.

9. Limitation of Liability

To the fullest extent permitted by law, Canvas and Crew shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, any template or the Marketplace.

10. Termination

We reserve the right to refuse service, cancel template transfers, or revoke your access to the Marketplace at any time if we determine, at our sole discretion, that you have violated these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms shall be resolved through good-faith negotiation, and if necessary, through appropriate legal proceedings.

12. Changes to Terms

We reserve the right to update these Terms at any time. Continued use of the Marketplace after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this document periodically.
